Terms of Service

1. Who these terms are with
These Terms of Service govern your use of the Platos app, the Platos Plus subscription, the Platos Monitor and connected hardware, and our websites (together, the “Service”).
If you are in the European Economic Area or the United Kingdom, your agreement is with Platos Health B.V., Haparandaweg 594, 1013 BD Amsterdam, Netherlands (“Platos”, “we”, “us”). If you are in Nigeria, your agreement is with Platos Health Africa Integrated Services Limited (RC 1725224) (“Platos”). By using the Service you accept these Terms and our Privacy Policy. Our Privacy Policy explains how we process personal data. Where we rely on consent, including explicit consent for special category data where required, we will ask for that consent separately. If you do not accept them, do not use the Service.
These Terms cover the consumer product (the app, Platos Plus, and the Platos Monitor devices). If you access Platos through a clinical partner under our experimental remote monitoring offering, that use is governed by the separate agreement with that partner, not by these consumer Terms.
2. What Platos is, and what it is not
Platos is a wellbeing and metabolic intelligence service. It helps you view and understand non-diagnostic trends in your lifestyle, body-composition, physiological, biomarker, and metabolic-related data. The Service may suggest general behavioural actions, such as adjustments to nutrition, sleep, activity, and stress, for wellbeing purpose only.
Platos is not a medical device, and it does not diagnose, treat, cure, or prevent any disease. It is a wellbeing service that helps you understand metabolic trends, not a medical service. The readings and insights it produces are informational. Some are generated by a beta inference engine and are shown with an indication of their reliability. They can be wrong.. Platos does not replace advice from a qualified clinician, and you should not make medical decisions based only on the Service. Always consult a professional for medical concerns, diagnosis, treatment, or changes to medication. The Service is not for emergencies. If you think you may have a medical emergency, call your local emergency number immediately.
3. Eligibility
You must be at least 18 years old and able to form a binding contract. By using the Service you confirm that you are.
4. Your account
To use most features you create an account. You are responsible for keeping your credentials secure and for activity under your account. Tell us at support[at]platoshealth.com if you think your account has been compromised.
5. Early Access (BETA) Programme
1. Scope and eligibility. Access to Platos during the early-access period is by personal invitation only, is non-transferable, and is limited to individuals aged 18 or over. Participation is for the duration of the beta programme, which we may change, suspend, or end at any time.
2. Confidentiality. The early-access build, its features, screens, and any non-public information you learn through it are confidential. You agree not to share access, publish or post screenshots or recordings, redistribute the app, or transfer your invitation to anyone else.
3. Provided "as is." The early-access build is a pre-release, unfinished product. It may contain errors, be interrupted, or change, and features may be added, altered, or withdrawn without notice. It is provided without warranties of any kind. It is not a medical device and must not be relied upon for any medical decision, diagnosis, or treatment (see the Not-a-Medical-Device acknowledgement). Always consult a qualified professional for medical advice.
4. Feedback. You may choose to give us feedback about the app. You grant Platos a perpetual, worldwide, royalty-free licence to use that feedback to operate and improve the product, with no obligation to you. Feedback is not treated as your confidential information. This does not affect your own health and personal data, which remains yours and is governed by the Privacy Policy.
5. Your data and withdrawal. You may stop participating at any time. You may access, export, and request deletion of your personal data as described in the Privacy Policy. Your metabolic readings, lab measurements, and body-composition history remain associated with your account and travel with you.
6. Nature of the programme (use restriction). The early-access programme is a limited, controlled test made available to invited participants for evaluation and feedback, not a general commercial offering. You agree to use the app only for that purpose during the beta period.

8. Changes and termination. We may update these terms or end the early-access programme at any time. Where required, we will give reasonable notice. Continued use after an update means you accept the updated terms.
9. Governing law.
6. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use. You agree not to:
- use the Service unlawfully or in breach of any applicable regulation;
- copy, resell, sublicense, or commercially exploit the Service;
- reverse engineer or attempt to extract source code, except where the law expressly permits it;
- upload malicious code, interfere with the Service, or attempt to access other users’ data;
- misrepresent your identity, age, or affiliation.
We may suspend or end your access if you break these Terms.
7. The Platos Monitor and connected hardware
The Platos Monitor is a line of consumer devices. The devices available today are the PS08 and PS04 body-composition monitors (smart body-fat scales); other devices may be added over time. Where you buy or use a Platos Monitor device or other hardware, it is provided for your personal use and not for resale. Measurements from the hardware are presented as personal trends and estimates, not clinical results or diagnostic measurements. Statutory consumer guarantees that apply to the hardware in your country are not affected by these Terms.
Shared devices, in-store scans, and guest use. You do not need to own a device to use Platos. Some partners offer an in-store scan on a single shared device for a small fee, and some organisations place a device in a shared space such as an office. In every case, your measurements sync to your own Platos account only after you identify yourself or connect the scan to your account through the process shown at the scan location or in the app. If you are scanned as a guest, we store that scan data for 30 days so you can claim it to an account using a code we provide. If you do not claim it within 30 days, we delete it. Any fee for an in-store scan is set and charged by the partner that provides it, not by Platos.
8. Subscriptions, pricing, and payment
Platos Plus. Platos Plus is a paid subscription. The current price and billing period are shown to you before you buy, and the price displayed at the time of your purchase is the price that applies. Where we offer founding-member or promotional terms, the terms shown to you at purchase govern.
Billing and renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. We charge the payment method on file. Where you subscribe through the Apple App Store or Google Play, billing, renewal, and refunds are handled under that store’s rules.
Cancellation. You can cancel at any time, and cancellation takes effect at the end of the current billing period, so you keep access until then. Except where the law requires otherwise, amounts already paid are not refundable.
Right of withdrawal (EU and UK consumers). If you are a consumer in the EEA or the UK, you have 14 days to withdraw from your purchase without giving a reason. If you ask us to start your subscription during that 14-day period, you agree that we may begin straight away, and: (a) if you then withdraw before the period ends, you pay a proportionate amount for what you used up to that point; and (b) once the service has been fully performed, the right to withdraw is lost. Where you buy through an app store, its own cancellation and refund process may also apply, and you may need to exercise withdrawal or request a refund through that app store. Changes to price. We may change prices or add paid features. A price change applies from your next billing period after we notify you, and you can cancel before it takes effect if you do not accept it.
9. Third-party services
The Service may connect to third parties you choose, such as Apple Health, Google Health Connect, laboratory partners, and payment providers. Their own terms and privacy policies may apply. Our Privacy Policy explains, where relevant, whether Platos and/or those third parties act as separate controllers or processors for the personal data involved. Platos remains responsible for its own processing of personal data under applicable data protection law.
10. Your content
You keep ownership of the data and content you provide. You grant us the license needed to operate, maintain, secure, and improve the Service for you, including to host, store, transmit, display, analyse, and otherwise process your content and wellbeing and metabolic data as described in the Privacy Policy and subject to your explicit consent where required. You are responsible for the accuracy of what you enter.
11. Intellectual property
The Service, including its software, models, interfaces, text, and branding, belongs to Platos or its licensors and is protected by law. Except for the license in Section 5, we grant you no rights in it.
12. Changes to the Service and these Terms
We may update the Service and these Terms. For material changes we will update the date above and give notice in the app or by email. Continued use after changes take effect means you accept them. If you do not accept, stop using the Service.
13. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Service will be uninterrupted, error-free, or that any inferred reading is accurate. Nothing in these Terms excludes liability that cannot be excluded by law, including statutory consumer rights.
14. Limitation of liability
To the extent permitted by law, Platos is not liable for indirect, incidental, or consequential loss, or for loss of profits, data, or goodwill. Our total liability to you arising out of or relating to the Service is limited to the greater of the total amount you paid us for the Service in the 12 months before the event giving rise to the claim, or 500 euro. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence or for intent or conscious recklessness, your rights and remedies under applicable data protection law (including compensation for damage caused by an infringement of the GDPR), and any non-excludable statutory rights you have as a consumer.
15. Governing law and disputes
For users in the EEA or UK, these Terms are governed by the laws of the Netherlands, and disputes are subject to the competent court in Amsterdam, without removing any mandatory consumer protection you have in your country of residence. For users in Nigeria, these Terms are governed by the laws of the Federal Republic of Nigeria, with disputes referred to mediation at the Lagos Multi-Door Courthouse before litigation.
16. General
These Terms are the entire agreement between you and Platos about the Service. If a provision is unenforceable, the rest still applies. We may assign these Terms as part of a corporate transaction. Our failure to enforce a right is not a waiver of it.
